On September 28, 2021, the Court granted final approval of a $6.75 million settlement on behalf of 17,208 used car dealerships in Red Barn Motors, Inc. et al. v. Nextgear Capital, Inc., Southern District of Indiana Case No. 1:14-cv-01589-TWP-DLP. Class Members alleged that NextGear charged interest and fees on funds that had not been advanced, in breach of their floorplan financing agreements. Kathleen DeLaney successfully argued a Rule 23(f) appeal at the Seventh Circuit Court of Appeals resulting in a published decision Red Barn Motors, Inc. v. NextGear Capital, Inc., 915 F.3d 1098 (7th Cir. 2019). She also took the lead in representing the Class at the District Court’s class certification and fairness hearings.
