DeLaney & DeLaney LLC represented Don Tricarico, a distinguished veteran of the United States armed services with a military-related disability and the former Chief Administrative Officer of Marion General Hospital, in a disability and veteran discrimination case. Mr. Tricarico alleged that Marion General Hospital’s CEO terminated him because of her disdain for his military status, and in retaliation for engaging in protected activity under the Americans with Disabilities Act (ADA) and Uniformed Services Employment and Reemployment Rights Act (USERRA). The trial court denied summary judgment to Marion General Hospital on three of four claims: Tricarico v. Marion Gen. Hosp., Inc., 2021 U.S. Dist. LEXIS 169893 (N.D. Ind. 2021).
